LIBERDADE SINDICAL NO BRASIL: surgimento, evolução e novas perspectivas do contexto pós-88.

Resumo

O direito sindical é uma conquista histórica em constante construção. Desde o início e formação dos primeiros sindicatos, quando estes eram ilegais, até o seu reconhecimento e legitimidade expressa, muito se lutou para que se tivessem reconhecidos alguns direitos. A Constituição de 1988, no âmbito do Direito Coletivo do Trabalho brasileiro, foi um grande marco nesse sentido ao garantir alguns princípios como a liberdade sindical, e uma ampliação da legitimação de atuação dos sindicatos. O objetivo desse artigo é, por meio da rápida demonstração da evolução histórica da temática, mostrar a importância da atuação sindical e a sua gradual e constante conquista de direitos; traçando, ao fim, as novas perspectivas e necessárias mudanças pertinentes ao problema.

The right of workers to organize themselves into unions is an historical achievement in constant construction. Since the beginning of the first unions, when they were ilegal, until its express recognition and legitimacy, much fought was necessary in order to have some rights recognized. The brazilian Constitution of 1988, in the brazilian union’s law, has made a huge impact in this direction, ensuring some principles such as freedom of association, and broadening the legitimation of union’s acting. The aim of this paper is, through the brief demonstration of the historical evolution of the matter, show the importance of union activity and its gradual and steady acquiring of rights; mapping, by the end, new prospects and needed changes relevant to the problem.
